Local Government General Election
 

Local Government elections in BC are held every three years. For the RDKB, this includes the election of five Rural Area, or Electoral Area Directors to the RDKB Board of Directors. These Directors represent RDKB Electoral Areas A, B, C, D, and E.

RESIDENT ELECTOR

Voter Qualifications-Resident Elector

You may vote in the 2011 election as a Resident Elector if you meet all of the following criteria:

  1. You are a Canadian citizen;
  2. You are 18 years of age or older on or before general voting day;
  3. You are a resident of BC for at least 6 months immediately prior to the day of registration;
  4. You are a resident of the RDKB jurisdiction for at least 30 days immediately prior to the day of registration; and
  5. You are not disqualified by the Local Government Act or any other Act from voting in an election or be otherwise disqualified by law.

Rules for Determining Residency – Resident Elector
To determine residency for a resident elector the criteria are as follows:

  1. Person is a resident of the area where the person lives and to which, whenever absent, the person intends to return;
  2. Person may only be a resident of one area at a time for the purpose of voting in a local government election;
  3. Person does not change their area of residence until they have a new area of residence;
  4. Person does not cease to be a resident of an area by leaving the area for temporary purposes only;
  5. If a person establishes residency in a new area which is away from their usual area of residence for the purpose of attending an educational institution in the new area, the person may choose to vote in either area; but not in both.
  6. No corporation is entitled to be registered as an elector or have representative registered as an elector and no corporation is entitled to vote.


NON-RESIDENT (PROPERTY) ELECTOR

Voter Qualifications- Non-Resident (Property) Electors
If you own property in one place but live in another, you have the right to vote both where you live and where you own property subject to the conditions noted below.

You may vote in the 2011 election as a Non-Resident (Property) Elector if you meet all of the following criteria:

  1. You are NOT entitled to register as a Resident Elector of the jurisdiction;
  2. You are a Canadian citizen;
  3. You are 18 years of age or older on or before general voting day;
  4. You have lived in BC for at least 6 months immediately prior to the day of registration;
  5. You are the registered owner of real property (e.g. land with or without improvements) in the RDKB jurisdiction for at least 30 days immediately prior to the day of registration (Note: the only persons who are registered owners of the real property, either as joint tenants or tenants in common, are individuals who are not holding the property in trust for a corporation or another trust);
  6. You must only register in relation to one piece of property in the jurisdiction;
  7. If more than one person owns the property, only one owner may register and that person must have the written consent of a majority of the other owners; and
  8. You are not disqualified by the Local Government Act or any other Act from voting in an election or be otherwise disqualified by law.


HOW TO REGISTER

The RDKB maintains a voters list and conducts advanced voter registration. The RDKB also accepts voter registration on the day of general voting. You must submit a completed Resident Elector registration application form or a Non-Resident (Property) Elector registration application form and accompanying documents in order to register.

To register during advanced registration or on general voting day Resident Electors and Non-Resident (Property) Electors must produce two pieces of identification. This identification should prove both residency and identity. At least one piece must include a signature.

Acceptable identification includes:

  1. BC Driver’s Licence
  2. BC CareCard or Gold CareCard
  3. BC Identification Card
  4. Citizenship Card
  5. Social Insurance Card
  6. Credit Card

**Note to Non-Resident (Property) Electors: When you register to vote as a Non-Resident (Property) Elector, you will be required to bring a couple of additional pieces of documentation:

  1. If applicable, written consent from a majority of the registered owners stating that you are the one owner of the property who is designated as the Non-Resident (Property) Elector for that property,

  2. Proof of ownership of the property in question (for example, your tax notice, or a certificate of title printout). A utility bill or other similar documentation is NOT proof of ownership.

Registration of voters to enable you to be on this year's Regional District of Kootenay Boundary Voters List closes Tuesday September 27, 2011.

An Advance Registration Opportunity for eligible electors who are not on the Regional District of Kootenay Boundary Voter's List will be available up to September 27, 2011, Monday to Friday, excluding holidays at the:

ELECTOR QUALIFICATIONS

If you are 18 years or over on Voting Day (November 19, 2011) and you:

(a) are a Canadian Citizen; and
(b) have resided in British Columbia for at least 6 months immediately before the day of registration; and
(c) are a resident of your RDKB Electoral Area for at least 30 days immediately before the day of registration; and
(d) are not disqualified under the Local Government Act or any other Act from voting in an Election or Other Voting or be otherwise disqualified by law
you are entitled to vote as a RESIDENT ELECTOR.
If you are 18 years or older on Voting Day (November 19, 2011) and you:
(a) are a Canadian Citizen; and
(b) have resided in British Columbia for at least 6 months immediately before the day of registration; and
(c) are a registered owner of real property in your RDKB Electoral Area for at least 30 days immediately before the day of registration; and
(d) do not qualify to register as a resident elector; and
(e) are not disqualified under the Local Government Act or any other Act from voting in an Election or Other Voting or be otherwise disqualified by law; and
(f) provide satisfactory proof to the Chief Election Officer that you are entitled to vote pursuant to Section 55 of the Local Government Act then you may vote as a NON-RESIDENT PROPERTY ELECTOR.

Note: If there is more than one registered owner of the property, only one of those individuals may, with the written consent of the majority of owners, register as a non-resident property elector.

Resident Electors may register in advance or on Voting Day if you meet the qualifications set out above and have at least two pieces of identification that provide evidence of your identity and place of residence, at least one of which must contain your signature.

Non-Resident Property Electors may register in advance or on Voting Day if you meet the qualifications as set out in Section 57.1 of the Local Government Act. You also must have at least two pieces of identification that provide evidence of your identity and place of residence, at least one of which must contain your signature. Non-Resident Property Electors must also bring proof of ownership of property and if applicable, written consent from a majority of the registered owners stating that you are the one owner of the property who is designated as the non-resident property elector for that property.

Preliminary Lists of Electors and Registration Forms will be available, upon signature, for viewing at the Regional District of Kootenay Boundary Trail and Grand Forks offices: 843 Rossland Ave., Trail, B.C. and 2140 Central Ave., Grand Forks, B.C. and at Greenwood City Hall: 202 S. Government Avenue, Greenwood, BC.

Beginning Tuesday October 4, 2011, until the close of general voting on November 19, 2011, a copy of the list of registered electors will be available for public inspection, Monday to Friday, excluding holidays, at the Regional District of Kootenay Boundary Trail and Grand Forks offices: 843 Rossland Ave., Trail, B.C. (between 8:30 a.m. and 4:00 p.m.), and 2140 Central Ave., Grand Forks, B.C. (between 8:30 a.m. and 3:30 p.m.) and at Greenwood City Hall, 202 S. Government Avenue, Greenwood, BC (between 9:00 a.m. and 4:30 p.m.).

An objection to the registration of a person whose name appears on the list of registered electors may be made until 4:00 p.m., Friday, October 14, 2011.

An objection may only be made by a person entitled to be registered as an elector and can only be made on the basis that the person whose name appears has died or is not qualified to be registered as an elector.

Regional District of Kootenay Boundary 2011 Local Government General Election

Nominations
What is the process for nominations for someone wishing to run as a Director in the Regional District of Kootenay Boundary 2011 Local Government General Election?

A person must be nominated to run in the election. All the rules and legislation regarding running for a Regional District Director in a local government election are contained in Part 3 of the Local Government Act and Division 6 of Part 3 is specific to Nominations.

The nomination period begins at 9 am on Tuesday October 4, 2011 and ends at 4:00 pm on Friday October 14, 2011. This is the period for local government (e.g. RDKB) to receive nomination papers.

CANDIDATES (Nominees):
According to Section 66 of the Local Government Act a person qualifies to run for office if the person:

1. is a Canadian citizen; and
2. is 18 years of age or older; and
3. is a resident of B.C. for at least 6 months immediately before the day nomination papers are filed; and
4. is not disqualified by the Local Government Act or any other enactment from voting in an election in B.C. or from being nominated for, being elected to, or holding office.

According to Section 67 of the Local Government Act a person is disqualified to run for office if the person falls within any of the following:

1. Judge of the Court of Appeal, Supreme Court or Provincial Court,
2. Employee of the local government for which the election is being held,
3. Running for office of regional district electoral area director if one is an employee of a member municipality of that regional district,
4. Running for office of mayor or councillor if one is an employee of the regional district of which that municipality is a member,
5. Convicted of an offence under Division 17 of Part 3 of the Local Government Act, and
6. Disqualified under Sections 92, 92(4) of the Local Government Act and disqualified under Sections 110 and 191 of the Community Charter.

A person must be nominated by AT LEAST 2 QUALIFIED NOMINATORS. A person must not consent the nomination knowing that he or she is not qualified to be nominated.

NOMINATORS
According to Section 71 of the Local Government Act, a nomination for office must be made separately for each candidate as follows:

1. To be qualified as a “nominator” a person must be an elector of the jurisdiction for which the nomination is made (the candidate/nominee does not have to be an elector of the jurisdiction-see above Candidate/Nominee section).
2. Nominations must be accompanied by a) a statement signed by the person (candidate/nominee) consenting to the nomination and b) a solemn declaration of the person being nominated either made in advance or taken by the Chief Election Officer at the time the nomination documents are delivered. The forms for both a) and b) are part of the nomination package.
3. Written disclosure as required by the Financial Disclosure Act (this is part of the nomination package) is also required.
